EOFY Promotion Terms & Conditions

1. The promoter is Megasealed Bathrooms Australia Pty Ltd of Unit 5, 133 Beauchamp Road, Matraville NSW 2036 (“Promoter”).
2. The Megasealed EOFY Promotion (“Promotion”) starts on 20th May 2024 and ends on 30th June 2024 (“Promotion Period”).
3. Information on how to enter the Promotion form part of these Terms and Conditions.
4. The Promotion is only open to a resident of Australia aged 18 years or over.
5. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, Promotion suppliers and as required, to Australian regulatory authorities. Validity of an entry is conditional on providing this information. Any personal information provided will be held in accordance with the Megasealed Privacy Policy which can be accessed at https://www.megasealed.com.au/privacy-policy/
6. To be eligible to win a prize, the entrant must book a service with Megasealed during the Promotional Period. The job must be booked in and confirmed by 30th June 2024.
7. There is one (1) $500 Visa prepaid gift voucher available for a total prize pool of $500.
8. The Prize Draw will take place at Megasealed Bathrooms Australia Pty Ltd, Unit 5, 133 Beauchamp Road, Matraville NSW 2036 at 12:00pm (noon) AEST on 5th July 2024. The first valid entry drawn at random will win a $500 Visa prepaid gift voucher. The Winner will be notified in writing within two (2) business days of the draw. The name of the winner will be published on the Megasealed Facebook page on 12^th July 2024.
9. The Promoters reserve the right, at any time, to verify the validity of entries and reserve the right, in their sole discretion, to disqualify any entrant who the Promoters have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
10. The Promoters’ decisions are final and no correspondence will be entered into.
11. Subject to the unclaimed prize draw clause, if for any reason the winner does not redeem a prize by the time stipulated by the Promoters, then the prize will be forfeited.
12. If any prize is unavailable, the Promoters, at their discretion, reserve the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
13. A draw for any unclaimed prizes may take place on 5th October 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified in writing within two (2) business days of the draw.
14. The winner consents to the Promoter using their details in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
17. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Business; (f) use of the prize. The Promoters collect personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI.
